In most situations, it is necessary to go to court to have the divorce finalized. However, the spouse who was served with the divorce papers may not need to go to court if the spouses were able to reach an agreement or the spouse simply lets the other spouse proceed with a default order. In these situations, there is often a small amount of testimony the spouse seeking divorce gives and then the judge orders the divorce. If the case is contested, both spouses will need to go to court. In some cases, neither spouse has to go to court if the case is uncontested and the parties enter into a written settlement agreement.
