What if We Can't Agree on All Issues?

You and the other party can enter into mediation voluntarily. You are under no obligation to settle your dispute, even though this may be your goal. The mediator will explain that anything you say during this process cannot later be used in litigation if you do not settle your claim. In mediation, the mediator will use conflict resolution skills that are proven to assist with communication. This can help you and the other party communicate on a more respectful level and try to reach amicable decisions about at least some of the issues involved in your case. For example, you might be able to agree on a parenting plan even if you don’t agree on how to divide your property in a divorce or vice versa. You will then continue with litigation but only on those issues in which you do not have an agreement.
